Generative Artificial Intelligence (AI) has revolutionized content creation. From stunning visuals to automated copywriting, AI is now an everyday tool in a marketer's arsenal. However, the European Union's new AI Act and the associated Code of Practice have introduced a new set of rules: the official EU AI icons have arrived.
As a digital marketing agency, we believe in keeping our clients ahead of the curve. Here is everything you need to know about the latest regulations on AI content labelling.
What Content Needs to be Labelled?
The goal of the regulation isn't to ban AI, but to build public trust and reduce misinformation. Under Article 50 of the AI Act, you must clearly disclose the following to users:
-
Deepfakes: Artificially generated or manipulated image, audio, or video content that resembles existing persons, places, or events and could falsely appear authentic to an unsuspecting viewer.
-
Public Interest AI Text: Published texts that inform the public on matters of public interest, created without human review or editorial control.
The New Official EU Icons
The EU has designed a set of icons to help with visual transparency. While using these specific icons is optional, the obligation to disclose AI involvement is mandatory.
| Icon Type | When to Use It | Practical Example |
| Basic Icon | When AI was involved in creating the deepfake or text, or when combined with a custom text label. | A video overlay stating "Voices generated with AI" next to the icon. |
| Fully AI-Generated | When the entire content was generated by AI with no human creation (apart from prompting). | A completely AI-generated advertisement image featuring a fictional product. |
| Partially AI-Modified | When pre-existing, human-made content was significantly modified using AI. | Replacing the background of an authentic photograph using AI tools. |
When is Labelling NOT Required?
There are a few practical exceptions for content creators:
-
When the content is evidently part of an artistic, creative, satirical, or fictional work (though subtle disclosure that doesn't ruin the experience is still required).
-
When AI-generated text has undergone human review or editorial control, and a person or legal entity assumes editorial responsibility for it.
What Does This Mean for Your Brand?
Today, transparency is more than a legal obligation; it is a competitive advantage. Consumers value honesty. By openly communicating when your brand uses AI to enhance creative processes, you build lasting trust. Our agency is here to ensure that your campaigns are not only visually stunning but also fully compliant with the latest EU guidelines.
